These Terms of Service ('Terms') govern your access to and use of the LeaderLens platform, including our website, services, and any content provided through them. By accessing or using LeaderLens, you agree to be bound by these Terms. If you do not agree, do not use the platform.
Platform Rules
Eligibility
You must be at least 18 years of age to use LeaderLens. By creating an account, you represent that you meet this requirement and that all information you provide is accurate and complete.
Account Responsibility
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately if you suspect unauthorized access.
Prohibited Content
You may not use LeaderLens to submit false, defamatory, harassing, discriminatory, or legally actionable content. Ratings must be based on genuine workplace experience and must not include profanity, hate speech, threats, or personal attacks beyond the scope of professional evaluation.
No Impersonation
You may not impersonate another person, fabricate an identity, or misrepresent your employment relationship with any rated leader or organization.
Acceptable Behavior
Honest Ratings
All ratings must reflect your genuine, firsthand workplace experience with the leader in question. Do not submit ratings based on hearsay, secondhand accounts, or fabricated experiences.
One Rating Per Relationship
You may submit only one rating per leader with whom you have a direct reporting or peer relationship. Multiple ratings for the same leader from a single account are not permitted.
No Coercion
You may not coerce, incentivize, or pressure others to submit ratings — positive or negative — on your behalf or on behalf of any leader or organization.
No Data Scraping
Automated access, data scraping, bot usage, or systematic collection of platform content without written permission is strictly prohibited and may result in legal action.
Limitations of Liability
No Warranty
LeaderLens is provided 'as is' without warranties of any kind, either express or implied. We do not guarantee the accuracy, completeness, or reliability of any rating, score, or insight displayed on the platform.
Use at Your Own Risk
Decisions made based on ratings or leader profiles on LeaderLens are at your sole discretion and risk. We are not liable for employment decisions, business outcomes, or personal disputes arising from platform use.
Service Interruptions
We are not liable for temporary service interruptions, data loss, or technical failures beyond our reasonable control, including but not limited to internet outages, hosting failures, or force majeure events.
Cap on Damages
To the maximum extent permitted by law, LeaderLens' total liability for any claim arising from your use of the platform shall not exceed the amount you paid us in the 12 months preceding the claim, or $100 if you are a free user.
Moderation Rights
Content Review
LeaderLens reserves the right to review, edit, or remove any rating, submission, or account that violates these Terms, our community guidelines, or applicable law. We may suspend or terminate accounts without prior notice for serious or repeated violations.
Fraud Detection
We employ automated and manual fraud detection systems to identify suspicious patterns such as coordinated fake ratings, bot submissions, or repeated ratings from the same source. Flagged content may be quarantined for review.
No Obligation to Monitor
While we moderate actively, we are not obligated to pre-screen all content. We do not guarantee that every violation will be detected or acted upon immediately.
Appeals
If your content is removed or your account is restricted, you may submit an appeal to support@leaderlens.app within 14 days. We will review appeals in good faith and respond within a reasonable timeframe.
Intellectual Property Rights
Ownership of the Platform
LeaderLens, including its name, logo, branding, design, content, rating framework, trait categories, software, databases, graphics, text, user interface, and all related materials, is the exclusive property of LeaderLens and is protected by applicable copyright, trademark, trade secret, and intellectual property laws.
Trademarks and Branding
The LeaderLens name, logo, Leadership Intelligence branding, and all associated marks, graphics, and visual identifiers are proprietary assets of LeaderLens. You may not copy, reproduce, modify, distribute, display, publish, or use any LeaderLens branding without prior written permission.
Platform Content
All content provided through the platform, including but not limited to text, graphics, design elements, rating methodologies, trait definitions, reports, analytics, insights, and software functionality, is owned by or licensed to LeaderLens. No portion of the platform may be copied, reproduced, sold, licensed, republished, or distributed without authorization.
Limited User License
LeaderLens grants users a limited, non-exclusive, non-transferable, revocable license to access and use the platform solely for its intended purpose and in accordance with these Terms of Service. This license does not transfer ownership of any intellectual property rights.
Prohibited Use
You may not: (a) copy, reproduce, or redistribute platform content; (b) reverse engineer, decompile, or attempt to extract source code from the platform; (c) use automated tools, bots, crawlers, scrapers, or similar technologies to collect platform data; (d) create derivative works based on the platform, its content, or its proprietary methodologies; or (e) use LeaderLens branding, logos, trademarks, or trade dress in a manner that suggests affiliation, sponsorship, or endorsement without written permission.
User Submissions
Users retain ownership of any original content they submit to the platform. By submitting ratings, feedback, or other content, you grant LeaderLens a perpetual, worldwide, non-exclusive, royalty-free license to store, process, display, analyze, aggregate, and use such content for platform operations, reporting, research, analytics, moderation, and service improvement purposes.
Feedback and Suggestions
If you provide suggestions, ideas, recommendations, or feedback regarding LeaderLens, you acknowledge that LeaderLens may use, modify, implement, and commercialize such feedback without restriction or compensation.
Enforcement
LeaderLens reserves the right to investigate and pursue legal remedies against any unauthorized use, infringement, misappropriation, or violation of its intellectual property rights to the fullest extent permitted by law.
Subscription Policies
Plan Terms
Subscription plans grant access to premium features as described at the time of purchase. Features and pricing are subject to change with 30 days' notice to active subscribers.
Auto-Renewal
All paid subscriptions automatically renew at the end of each billing period unless cancelled. You can cancel at any time from your account settings. Cancellation stops future billing but does not immediately terminate access; subscriber access remains active until the end of the current paid billing period.
No Refunds
Subscription fees are non-refundable. Users may cancel at any time from their account settings. Cancellation stops future renewals. No refunds, credits, or prorated reimbursements are provided for partial billing periods, unused subscription time, or early cancellation.
Downgrades & Upgrades
Upgrading a plan takes effect immediately with prorated billing. Downgrading takes effect at the next billing cycle.
Free Trial
If a free trial is offered, it converts to a paid subscription automatically unless cancelled before the trial ends. We may require a valid payment method to initiate a trial.
Dispute Handling
Informal Resolution First
Before filing any formal legal claim, you agree to contact us at support@leaderlens.app and allow 30 days for informal resolution. Most issues can be resolved quickly through direct communication.
Arbitration
Any dispute, controversy, or claim arising out of or relating to these Terms or your use of LeaderLens shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules.
Class Action Waiver
You agree to resolve disputes on an individual basis and waive any right to participate in class actions, collective proceedings, or representative actions.
Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any court proceedings shall be brought exclusively in the state or federal courts located in Harris County, Texas.
